Welcome to Bark and Beauty AG, where luxury human cosmetology meets professional dog grooming under one roof. These Terms and Conditions govern your access to and use of our exclusive services, digital information network, online booking platform, online store, and mobile applications operated by or on behalf of Bark and Beauty AG, including without limitation www.barkandbeauty.ch and any other domains, websites, mobile applications, or digital platforms owned or operated by Bark and Beauty AG (collectively referred to as the “Bark and Beauty Platforms”).

By accessing or using any of the Bark and Beauty Platforms or our in-studio services, you agree to comply with and be bound by these Terms and Conditions, including any additional guidelines, rules, or policies that may be posted or communicated on our platforms from time to time.

In these Terms and Conditions, when we refer to "Bark and Beauty AG," "Bark & Beauty," "we," "our," or "us," we mean Bark and Beauty AG and its affiliates, subsidiaries, employees, directors, and agents. The term “you” or “your” refers to any individual accessing or using our services, platforms, or purchasing products from us.

These Terms and Conditions apply regardless of how you access the Bark and Beauty Platforms, including but not limited to, through our website, mobile applications, third-party sites, social media platforms, or any other digital or physical means.

If you do not agree to these Terms and Conditions, please do not use our services, website, or applications. Continued use of the Bark and Beauty Platforms constitutes acceptance of these Terms and Conditions.

1. General Overview

Bark & Beauty Grooming Wellness Studio offers:

  • Professional dog grooming services.
  • Luxury human cosmetology treatments.
  • Combined wellness experiences for pets and owners.
  • Medical Communication Services.
  • Education Offers.

These services are provided under the highest safety and quality standards, blending medical expertise and care.

2. Acceptance of Terms

By booking an appointment, visiting our studio, or purchasing services/products, you agree to be bound by these Terms and Conditions. If you do not agree, you may not access or use our services.

3. Client Eligibility

3.1 Human Clients

You must be 18 years of age or older to book human wellness or cosmetology treatments.

3.2 Pets

  • In good health, up-to-date on vaccinations (proof may be requested).
  • Non-aggressive and reasonably accustomed to grooming environments.
  • Accompanied by an adult owner during their appointments.

4. Service Bookings

4.1 Appointments

  • All appointments are subject to availability and must be booked in advance.
  • A deposit of 50 CHF is required to complete the booking for the dog grooming or cosmetology services. It will be deducted from the total service cost.
  • You may book online or in person at the studio.

4.2 Cancellations and Rescheduling

  • Cancellations must be made at least 48 hours before the scheduled appointment to avoid a cancellation fee.
  • Failure to attend an appointment without prior notice will result in forfeiture of 100% of the deposit.
  • Exceptions to the above include exceptional circumstances such as the death of a relative or pet, involvement in an accident, or other emergencies. In such cases, clients must notify us as soon as possible and provide relevant documentation or explanation to waive cancellation fees or reschedule the appointment without penalty.
  • Multiple no-shows or last-minute cancellations may result in a restriction on future bookings or additional fees.

4.3 Late Arrivals

  • For clients arriving 15 minutes late or more, Bark & Beauty reserves the right to cancel the appointment or shorten the service duration while charging the full-service price.
  • If you are late picking up your dog after the grooming appointment, a 10-minute courtesy period applies. After this, a fee of 15 CHF will be charged for every additional 10 minutes of delay. This amount is subject to change without notice.

5. Online Booking Application

5.1 User Registration and Account Security

  • To book services via our online booking platform or mobile applications, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
  • You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to ensure accuracy.
  • Bark & Beauty reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter is found to be inaccurate, false, or misleading.

5.2 Booking and Payments

  • All appointments are subject to availability and must be booked in advance.
  • A deposit of 50 CHF is required to complete the booking for the dog grooming or cosmetology services. It will be deducted from the total service cost.
  • Payments can be made through secure online payment gateways integrated into our online booking platform or mobile applications.
  • We accept all major credit cards and TWINT.

5.3 Cancellations and Rescheduling

  • No-shows or cancellations within 48 hours will result in forfeiture of 100% of the deposit or payment.

  • Multiple no-shows or last-minute cancellations may result in a restriction on future bookings or additional fees.

6. Online Store

6.1 Product Availability and Pricing

  • All products displayed on our online store are subject to availability.
  • Prices for products are listed in Swiss Francs (CHF) and may change without notice.
  • Bark & Beauty reserves the right to limit the quantity of products purchased per person, per household, or per order.

6.2 Orders and Payment

  • Orders can be placed via the online store available on our website and mobile applications.
  • Payment must be made in full at the time of purchase through secure payment gateways.
  • Accepted payment methods include major credit cards and TWINT.
  • An order confirmation will be sent to your registered email once payment is successfully processed.

6.3 Shipping and Delivery

  • Orders will be processed and shipped within 3-5 business days.
  • Shipping is currently only within Switzerland.
  • Shipping fees are calculated at checkout and depend on the delivery location.
  • Bark & Beauty is not responsible for any delays caused by third-party couriers or customs clearance processes.

6.4 Returns and Refunds

  • Products may be returned within 14 days of receipt for a full refund or exchange, provided they are in their original condition and packaging.
  • Refunds will be processed using the original payment method within 7-10 business days.
  • Return shipping costs are the responsibility of the customer unless the product is defective or incorrect.

7. Mobile Applications

7.1 App Usage and License

  • Bark & Beauty grants you a limited, non-exclusive, non-transferable, and revocable license to use our mobile applications solely for personal, non-commercial purposes.
  • You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from our mobile applications.

7.2 Updates and Modifications

  • Bark & Beauty may update the mobile applications from time to time to enhance user experience or ensure security.
  • You agree to receive and install such updates as required for the continued use of the mobile applications.

7.3 Third-Party Services and Links

  • Our mobile applications may contain links to third-party websites or services. Bark & Beauty is not responsible for the content, accuracy, or opinions expressed on these third-party websites.
  • Your interactions with third-party websites or services are governed by their own terms and conditions.

8. Health and Safety

  • Pet Safety: The groomer cannot be held responsible for the standard of grooming or mishaps that may occur while grooming dogs with behavioural problems. The owner agrees that if their pet needs extra time spent due to de-matting or behaviour, there will be an additional charge for this. If a dog exhibits aggressive or unmanageable behaviour, Bark & Beauty reserves the right to stop the grooming session for safety reasons.
  • Grooming of Sick or Elderly Dogs: This is done at the owner's risk. If the dog's health concerns us while in our care, the owner agrees to us seeking veterinary advice at their expense. Owners must disclose any known medical conditions in advance.
  • Pregnant Bitches: Bark & Beauty may or may not groom pregnant bitches, depending on their condition. If we proceed, Bark & Beauty will not be liable for any issues, complications, or consequences that may arise during or after the grooming process. Owners accept full responsibility for any risks involved.
  • Flea Occurrence: If fleas are discovered on a pet during grooming, we will take necessary steps to ensure the health and hygiene of all pets in the facility, including administering a flea treatment at an additional cost. Bark & Beauty reserves the right to stop the grooming session if the flea infestation is severe and poses a risk to other animals. Owners are responsible for any costs associated with flea treatments and additional cleaning or sanitisation required. A minimum charge of 80 CHF will be applied.
  • Severe Matting: If the dog's coat is matted, the groomer may have to shave off the coat due to the Animal Welfare Act. The owner understands when shaving off the pet's coat, there is a risk of cutting the dog. Permission to shave off a matted coat is obtained in the record card. Bark & Beauty is not responsible for haematomas or other injuries caused by matting. The additional cost of 80 CHF per hour will be applied.
  • Dog Health Issues: The groomer will not be held liable for any underlying skin or health problems that grooming may expose.
  • Sanitation: All tools, equipment, and treatment areas adhere to strict hygiene standards.
  • Emergency Contact Requirement: Pet owners must provide an emergency contact number during appointments for urgent decisions regarding health or behavioural issues. If the dog's health concerns us while in our care, the owner agrees to us seeking veterinary advice at their expense.
  • Prohibited Items and Conduct: Clients are prohibited from bringing external food or unvaccinated pets into the facility. Aggressive pets without prior warning may result in refusal of service.

9. Cosmetology Treatments

  • Clients undergoing medical treatments or with health concerns must consult their physician before receiving cosmetology treatments.
  • Clients must disclose any allergies, skin sensitivities, medical conditions, or recent procedures (e.g., surgery, laser treatments) before receiving cosmetology services.
  • We are not responsible for adverse reactions, such as redness, irritation, bruising, or swelling, resulting from procedures including but not limited to:
  • Manicure, pedicure, waxing, and permanent makeup.
  • Facial treatments (e.g., microdermabrasion, deep cleaning).
  • LED therapy, body therapies, laser treatments, and other manual or machine-operated treatments.
  • Clients must adhere to pre- and post-treatment care instructions provided during consultation.
  • Results of treatments may vary based on individual skin type and aftercare compliance.
  • Sanitation: All tools, equipment, and treatment areas adhere to strict hygiene standards.
  • Limitation of Liability for Cosmetic Outcomes: Bark & Beauty does not guarantee specific results for cosmetic treatments as outcomes may vary based on individual factors.
  • Modification of Treatments: Requests for customised or modified treatments will be assessed and accommodated where feasible, subject to additional costs if applicable.

10. Third-Party Product Liability

Bark & Beauty uses high-quality products for all services. However, we are not responsible for any adverse reactions, damage, or outcomes resulting from third-party products (e.g., shampoos, conditioners, machinery, skincare products) supplied by external manufacturers. Clients are encouraged to disclose any known allergies or sensitivities to avoid potential issues.

11. Payment Policies

  • Full payment is required upon completion of services.
  • We operate on a cashless basis and accept all major credit cards and TWINT.
  • All prices are listed in Swiss Francs and are subject to change without notice.
  • Refunds will not be provided for dissatisfaction due to issues disclosed beforehand (e.g., matting, skin conditions).
  • Refunds for dissatisfaction or service quality concerns may be reviewed on a case-by-case basis. Refund requests must be submitted within 7 days of the service.
  • Pricing adjustments will be communicated via email, posted notices, or other suitable channels, with at least 7 days' notice before taking effect.
  • Missed Payments: Failure to pay for completed services may result in the refusal of future bookings and additional penalties.
  • Promotional codes, discounts, and special offers are non-cumulative, cannot be applied retrospectively or combined with other ongoing promotions, and are valid only for the duration and conditions specified in each offer.

12. Indemnity Clause

Clients agree to indemnify and hold Bark & Beauty harmless against any claims, damages, or liabilities resulting from failure to disclose pertinent health or behaviour information or any actions of third parties.

13. Force Majeure

Bark & Beauty is not responsible for delays or cancellations caused by events beyond our control, including natural disasters, pandemics, or government restrictions.

14. Media Release

With the client's consent, Bark & Beauty may use photos or videos of pets or clients taken during treatments for marketing purposes. Clients retain the right to decline this usage.

15. Pet Health Requirements

To ensure a safe and stress-free grooming environment, all pets must:

  • Be up-to-date on core vaccinations (proof may be requested during your visit).
  • Not exhibit any contagious conditions (e.g., fleas, ticks, skin infections).
  • Be free from significant health issues that could compromise their safety during grooming.

Bark & Beauty reserves the right to refuse service to pets that do not meet these criteria.

16. Code of Conduct

  • Clients must behave respectfully towards staff, other clients, and pets on the premises.
  • Abusive or inappropriate behaviour will not be tolerated and may result in termination of services.
  • Children in the facility must be supervised by an adult at all times to ensure their safety and maintain a calm environment.
  • Clients must follow all safety precautions while on the premises, including avoiding restricted grooming areas unless explicitly permitted.
  • Clients are advised not to leave personal belongings unattended, as Bark & Beauty Grooming Wellness Studio cannot accept responsibility for any loss or damage to items left on the premises.

17. Privacy Policy

  • Bark & Beauty is committed to protecting your personal information in compliance with applicable data protection laws.
  • Please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your data.

18. Intellectual Property

  • All content, logos, trademarks, and proprietary information displayed on the Bark & Beauty Platforms, including the online store and mobile applications, are the property of Bark & Beauty AG.
  • You are prohibited from using any content or trademarks without prior written consent from Bark & Beauty AG.

19. Complaints and Feedback

20. Changes to Terms and Conditions

Bark & Beauty reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of significant changes. Continued use of our services following updates constitutes acceptance of the revised Terms.

21. Accuracy of Information and Consequences of Misinformation

By completing the registration form, you agree to provide accurate and truthful information. If it is discovered that incorrect, false, or misleading information has been provided, we reserve the right to:

  • Refuse service at any time without prior notice.
  • Enforce an immediate and lifelong ban from accessing our business premises.
  • Seek full compensation for any damages, losses, or liabilities (100%) incurred as a result of the misinformation.

In the event of any disputes arising from these Terms and Conditions, Zurich Kanton arbitration authorities in Switzerland will serve as the exclusive place for conflict resolution.

22. Governing Law

  • These Terms shall be governed by and interpreted in accordance with the laws of Switzerland.
  • Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts of Zurich Kanton, Switzerland.
